On 28 March 2024, President Biden issued a Memorandum establishing new agency requirements and guidance for AI governance, innovation, and risk management, including through specific minimum risk management practices for uses of AI that impact the rights and safety of the public. Specific actions required by agencies include:
- Designating a Chief AI Officer;
- Developing and making available a Compliance Plan;
- Prepare and individual inventory for each AI Use Case at least annually;
- Reporting on AI Use Cases not subject to inventory such as, Department of Defense;
- Develop and publicly release a strategy for identifying and removing barriers to the responsible use of AI;
- Agencies must share their AI code, models, and data, and do so in a manner that facilitates re-use and collaboration Government-wide and with the public, subject to applicable law and government guidance; and
- Implement Risk Management Practices or else stop using any AI in their operations that is not compliance with minimum practices as required by the Memorandum.
The AI Policy Memorandum follows President Biden’s AI executive order in October 2023, and the National Institute of Standards and Technology’s AI Risk Management Framework in January 2023.
